Building Services Terms and Conditions
These conditions explain your rights and obligations when using our building services.
1. Quotation and Pricing
1.1 Our quotation, unless otherwise stated, does not include permits, inspections, or other fees payable to government bodies. It includes our acceptance of liability for the work carried out, subject to clauses 2.2, 3.2, 5.2, 5.3, and provisions of Clauses 4, 9, 10, 11, and 12.
1.2 We may adjust the price or make additional charges if circumstances arise that were not considered when preparing the quotation. These may include:
1.2.1 Changes in taxation, materials costs, or labor charges beyond our control.
1.2.2 Work conducted outside normal business hours, weekends, or public holidays at your request.
1.2.3 Access difficulties or site restrictions requiring additional resources or equipment.
1.2.4 Additional services or modifications requested after work has begun.
1.3 Any adjusted charges will apply and become payable.
1.4 The site must be safe and accessible for our team. We reserve the right to halt work if access is unsafe or obstructed.
2. Work Not Included in the Quotation
Unless agreed in writing, we will not:
2.1 Dismantle or assemble client-supplied furniture or fittings.
2.2 Connect or disconnect appliances or equipment unless specified.
2.3 Perform work outside the agreed scope without written approval.
3. Your Responsibilities
3.1 You are responsible for:
Providing accurate details of the work required.
Ensuring necessary permissions, permits, or licenses are obtained.
Ensuring safe access to the property for our team.
Protecting any items or areas not included in our work.
3.2 We are not liable for any loss, damage, or additional costs arising from failure to meet these responsibilities, except in cases of negligence or breach of contract.
4. Our Responsibilities
4.1 We are responsible for completing the work agreed in the quotation to a professional standard.
4.2 Any damage caused by our negligence will be repaired or compensated, subject to clauses 9, 11, and 12.
4.3 Our liability does not extend to work outside our scope or caused by factors beyond our control.
5. Restricted Materials or Items
5.1 Unless agreed in writing, we do not work with:
Hazardous or illegal materials.
Items requiring specialized licenses or handling.
5.2 Any work involving such items will only proceed under separate agreement, and we accept no liability for loss or damage unless due to negligence.
6. Ownership and Authority
By entering this agreement, you confirm that you own or have authority to arrange the building works. You will be liable for any claims if this warranty is untrue.
7. Postponement or Cancellation
7.1 If you postpone or cancel, charges may apply based on notice given:
5–10 working days: up to 30% of the quoted price.
Less than 5 working days: up to 60% of the quoted price.
8. Payment
8.1 Payment is required as agreed in the quotation. Full or partial advance payments may be requested before work commences.
9. Liability
9.1 Standard Liability: We are liable for repair or replacement of work performed, subject to a maximum limit agreed in writing.
9.2 Limited Liability: Without prior agreement, our liability is limited to £500 per item or incident for any loss or damage caused by negligence.
9.3 We are not liable for indirect, consequential, or unavoidable losses.
10. Damage to Property
10.1 We will repair or compensate for any damage caused to property due to our negligence.
10.2 We are not responsible for pre-existing defects or damage caused by others.
11. Exclusions
We are not liable for damage caused by:
Acts of God, fire, flood, or other natural events.
Normal wear and tear.
Client-supplied materials or defective equipment.
12. Time Limit for Claims
12.1 Any claims for defective or damaged work must be notified in writing within 7 days of completion.
12.2 Claims received after this period may not be considered.
13. Delays
13.1 We are not liable for delays outside our control.
13.2 Additional services due to delays are chargeable.
14. Subcontracting
14.1 We may subcontract work, but these terms will still apply.
15. Route and Method
We determine the method and route for delivery of materials and equipment to the site.
16. Applicable Law
This contract is governed by the law of the country in which SD Builders Ltd operates.
17. Termination
Either party may terminate the agreement by providing written notice as per the terms specified in the quotation.
